1. Who are we? All of WinnerWeb’s competitions are promoted by WinnerWeb Limited (“WinnerWeb” or “the Promoter”). WinnerWeb is a company registered in England (company number: 06707727) with a registered office at WinnerWeb Ltd, Unit 3, The Redlands Centre, Coulsdon, Surrey, CR5 2HT. 2. Participation in competitions. Every competition promoted by WinnerWeb is open to all persons aged 18 and over except anyone prohibited by law (either English law or an entrant’s own national law) from entering into a competition of the type offered by WinnerWeb. Of course, any of WinnerWeb’s employees or members of their immediate family, agents or any other person who is connected with the creation, judging, monitoring or administration of any competition or WinnerWeb generally are not eligible to enter.
3. The rules. By entering a competition, the entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. There may be additional rules or legal requirements for the specific competitions, so please read and understand the specific terms and conditions for each individual prize which are displayed on the same page of the prize to which they apply. The entrant will be bound by both the specific terms and conditions and these rules which apply to all competitions’ prizes.
4. Applicable law and jurisdiction. Each competition is governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing this competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. The Promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt, you should immediately leave the website, not enter the competition, and check with the relevant authorities in your own country.
5. Playing instructions.
Online. When playing a competition online, follow the on-screen instructions and play the competition as outlined in paragraph (a) above. When you are ready to play, follow the on-screen instructions to complete the gaming, payment and checkout process. When your Google checkout / credit card payment is cleared, we will then immediately contact you by e-mail to confirm your entry into the competition. Please note that, when entering online, you will not be deemed entered the competition until we confirm your ticket details back to you by e-mail. You must retain this e-mail as confirmation of your entry and to validate your entry and be eligible to win the prize.
6. Gift vouchers. To pay for your ticket using a gift voucher, follow the respective playing instructions outlined in paragraph 5 above. To make the payment, enter the voucher code that is supplied. Your entry into the competition will be confirmed when the voucher code is authorised. Please note that game plays can only be purchased for up to and including the value of the voucher. No refund for any unused credit or amount on the voucher will be provided by the Promoter. The voucher can only be used to play the competition online. If you wish to purchase a ticket that has a greater value than that of the voucher, it is possible to pay for the remainder using your Google account / credit card. Please note again if you are using the vouchers as payment when playing the competition online, you will not be deemed entered into the competition until we confirm your ticket back to you by e-mail.
7. Determination of the winner. For each individual competition, the centre of the ball position has been securely stored by our gaming insurance provider. Each time a game is played the entries are compared automatically through a secure connection to our gaming insurance providers database. The winner will be the person who correctly identifies the centre of the ball is located.
8. Notification and identification of the winner. The winner of each competition will be notified immediately after their entry has been made and verified. When the monthly competitions finish and in the event of no player guessing the position of the ball, the player whos guess came nearest to the winning position will win £250. They will be notified at the email, postal address or telephone number given in the contact details within 14 days of the closing date of the relevant competition. Any entrant may check the results of competitions completed within the last 6 months at our website http://www.WinnerWeb.net. The winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that, if the purchase was made by credit card, the card was legally theirs or they had authorisation to use it, before any prize will be paid or delivered. The winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements for delivery of the prize. At this point, the winner must choose between the prizes available and notify WinnerWeb in writing. In the event that the winner does not send the requested documents to the Promoter and/or the winner’s details cannot be verified, after 10 days from and including the date the winner was identified, the original winner will be deemed replaced by the person judged to have submitted the second best entry. If the second winner cannot be identified within 10 days from the date the second winner was identified then he/she will be replaced by the third best entry, and so on until we can verify the identity of a winner.
9. Cash alternative to the prizes. The prizes for each competition will be as advertised at http://www.WinnerWeb.net. In some instances and for some competitions and prizes, if the winner does not wish to take delivery of one of the prizes, a cash alternative may be available to be taken by the winner. This cash alternative is not always available but, if it is, it will be advertised in the additional terms and conditions for that competition and prize.
10. Rights of the Promoter. Acceptance of the prize by the winner gives the Promoter the right to use the prize-winner’s name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law. The Promoter reserves the right to cancel any competition, for any reason, before the designated closing date. In these circumstances, the Promoter reserves the right to transfer the customer’s ticket into another competition for which the ticket price is at least the same or more than the original price paid. The Promoter also reserves the right, at its sole discretion, to extend the closing date on any time-limited competition even if that competition is also subject to a pre-determined number of qualifying ticket sales.
During the course of a competition, the Promoter reserves the right to change the prize to one of an equal or greater value. Some cars may have more than delivery mileage only, especially in the case of cars with limited production runs or deemed to be classic cars, either traditional or modern/future classic cars. Some cars may be registered and some may be unregistered.
11. Exclusion of liability of the Promoter. The Promoter makes no representations or warranties as to the quality/suitability/value of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to persons or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Promoter. No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.
12. Data Protection Notice. All entrants to any of WinnerWeb’s competitions are automatically entered on to WinnerWeb’s database for the purpose of conveying information as to the status of the competition entered, as well as for any future promotions, competitions or deals offered by WinnerWeb. Data that we retain includes personal data. All data that we hold is subject to our Privacy Policy
Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party (for example, a credit card company) will be used by the Promoter (i) to administer the competition; and (ii) (unless you tell us that you prefer not to receive direct marketing) to contact you about other competitions or about other goods and services which the Promoter considers may be of interest to you. In order to process, record and use your personal data, the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
13. Gaming prohibitions. WinnerWeb’s competitions are conducted under English law as a skill-based game and not as a lottery or a raffle. It is your responsibility to observe the national laws of your own country regarding possible gaming or gambling prohibitions and to make sure that you are allowed to enter the various competitions. Online gaming is only permitted for adults. We believe in responsible online gaming and entertainment. For most people, gaming or gambling is entertainment. However, some players cross the boundary into irresponsible gaming. WinnerWeb offers a spot-the-ball game for entertainment and excitement within an affordable and manageable budget. 14. Changes in these Terms and Conditions. You should print out the rules of the game or competition that you have entered and keep them in an easily accessible place. The Promoter reserves the right from time to time to change its Terms and Conditions, Privacy Policy or any other legal aspect of its competitions, website or its basis of trading with its customers. The Promoter will do so by a clear posting on its website http://www.WinnerWeb.net giving 28 days' notice at any point; but the terms and conditions in place at the time of entering any competition shall be the terms and conditions applicable to your entry in that competition.
